South Forty Tours is a division and registered tradename of South Forty Transportation Ltd. and will herein be referred to as “South Forty”.
1. Booking & Payment
a. Confirmation: Service is confirmed upon written acceptance of a quotation or completion of the online booking process.
i. Website Booking of request planned tour
ii. Emailed QuickBooks Invoice for all guests
iii. Payment of Deposit or Full Tour cost depending on date of departure and date of booking
iv. Confirmation email
b. Reservation Deposit: A reservation deposit equal to 25% of the total package price is required to confirm the booking unless otherwise stated in writing.
i. For cancellations greater than forty-five (45) calendar days prior to departure, the deposit is fully refundable
ii. For cancellations less than forty-five (45) calendar days prior to departure, the deposit becomes non-refundable
iii. Payment is due upon receipt of invoice.
c. Progress/Final Payment: The remaining 75% is due forty-five (45) calendar days prior to departure. Bookings made within forty-five (45) calendar days of departure require full payment at time of booking.
d. Accepted Methods: EFT, E-transfer (preferred method), Credit & Debit

e. Late Payments: A 1.5% monthly interest charge to a maximum of 18% annually, will apply to overdue balances. Any Late payments put your reservation in jeopardy of cancellation.
f. Group Bookings: The Purchaser, the passenger purchasing for the group, is responsible for all payments, communications, and consents on behalf of all Guests in their booking.
2. Cancellations & Refunds (Pre-Departure)
a. Guest Cancellations
i. More than forty-five (45) calendar days of departure: Full refund of amounts paid, including deposit.
ii. Between thirty (30) and forty-five (45) calendar days: Deposit becomes non-refundable, and fifty percent (50%) of the remaining tour balance is due and non-refundable.
iii. Less than thirty (30) calendar days: Full tour fee is due and non-refundable
b. Name Changes: Guest Reservations are transferrable and permitted up to fourteen (14) calendar days before departure, subject to a fifty Canadian dollar (CAD$ 50.00) administrative fee per name change.
c. Operator Cancellations:
i. In the unlikely event South Forty must cancel a tour due to weather, mechanical, or safety issues, Guests may elect a full refund or rebooking on a future tour. No consequential or incidental damages will be paid.
d. Refund Method:
i. Refunds will be returned to the original payment source within 15 business days of written cancellation acceptance. All refunds are non-interest-bearing and limited to the amount originally paid.
3. Service Delays, Downtime & Overages
a. Schedule Adherence:
i. Tours depart and return as scheduled. Guests must be ready at the designated pickup times.
ii. If for any reason there will be a delay, immediate contact with the assigned tour guide or bus driver is crucial to avoid being left behind or causing further disruption to the schedule.
b. Late Guests and Voluntary Withdrawal:
i. Failure to arrive at pickup locations on time may result in forfeiture or the day’s participation without refund, up to and including being left behind.
ii. If a Guest cannot be located or contacted within a reasonable time (typically fifteen (15) minutes) of the scheduled departure, the Tour will proceed, and the Guest will be considered to have voluntarily withdrawn for that segment of the Tour.
iii. No refund, credit, or alternate transportation will be provided in such cases.
c. Personal Belongings of Left-Behind Guests:
i. If a Guest is left behind or voluntarily withdraws from the Tour, any personal belongings remaining on board will be inventoried and secured where reasonably possible.
ii. Items may be returned by mail or courier at the Guest’s expense or collected at South Forty’s facility by arrangement.
iii. South Forty assumes no liability for lost, damaged, or unclaimed property after the Tour concludes
iv. Unclaimed property remaining in South Forty’s possession after ninety (90) calendar days will be considered abandoned and may be sold, donated, repurposed, or otherwise disposed of at South Forty’s convenience. Proceeds, if any, will not be held in trust or remitted to the Guest.
d. Rejoining the Tour after being left behind:
i. If a Guest misses a scheduled departure or segment of the Tour for any reason, including but not limited to oversleeping, illness, or failure to appear at the designated meeting time, the Guest may rejoin the Tour at a later stop at their own expense.
ii. South Forty may, at its sole discretion, provide information or assistance to facilitate rejoining, but assumes no obligation to provide alternate transportation, refunds, or reimbursements for missed activities, accommodations, or meals.
e. Medical Emergencies and High-Risk Activities
i. Certain activities arranged as part of the Tour, including but not limited to hiking (summer and winter), snowshoeing, and cross-country skiing, may involve inherent risks. These activities are conducted by independent third-party vendors who maintain their own safety protocols, equipment, and insurance.
ii. South Forty acts solely as a coordinator and assumes no responsibility for the conduct, safety, or outcomes of such activities.
iii. In the event of illness, injury, or other medical emergency, South Forty will assist in contacting emergency services and coordinating care, including ambulance transport if required.
iv. All associated costs—including ambulance or air-ambulance transport, out-of-province medical expenses, and return travel—are the sole responsibility of the Guest.
v. Guests are strongly encouraged to carry comprehensive travel and medical insurance covering these circumstances.
f. Personal Belongings of a Guest with a Medical Emergency
i. In the event a Guest requires medical evacuation or hospitalization, South Forty will make reasonable efforts to secure and deliver the Guest’s personal belongings to the receiving medical facility or attending emergency personnel.
ii. South Forty will cover reasonable local costs associated with the transfer of these belongings to ensure continuity of care and personal identification.
iii. If transfer is not immediately possible, belongings will be inventoried, secured, and held until delivery can be arranged.
iv. Once transferred, South Forty’s responsibility for those belongings is considered fulfilled, and no further liability will be assumed for loss or damage thereafter.
g. Force Majeure:
i. South Forty shall not be held liable for failure to perform or delays in service due to circumstances beyond its reasonable control, including but not limited to: inclement weather, wildfires, natural disasters, road closures, labour disputes, pandemics, legal restrictions, or government-issued regulatory orders (including Out-of-Service notices), provided that such interruptions are not the result of gross negligence or willful misconduct.
4. Mechanical Failure Contingency (During Tour)
a. In the event of a mechanical issue rendering a vehicle inoperable, South Forty will make commercially reasonable efforts to:
i. Repair or replace the vehicle within a reasonable time.
ii. Source a backup vehicle from South Forty or a third party at no additional cost (subject to availability).
iii. Minimize disruption and keep Guests informed.
b. If a full replacement is not available and the schedule is materially affected, a pro-rated credit will be issued for the affected portion. South Forty is not liable for consequential losses.
5. Guest Conduct and Responsibility
a. Behaviour:
i. South Forty may refuse or remove any Guest whose conduct endangers others, causes property damage, or is otherwise inappropriate, without refund
b. Substances:
i. Alcohol, tobacco, vaping, and cannabis use, or consumption are prohibited on all South Forty vehicles, including within ten (10) meters of the vehicle entrance door, and are otherwise subject to applicable law and local tour rules. Violation of these restrictions may result in removal without refund.
c. Damage:
i. Guests are liable for damage to vehicles, accommodations or property resulting from negligence or misconduct. Charges will include repair cost-plus twenty-five percent (25%)
ii. Guests do not need to be caught in the act of causing damage. If, in South Forty’s reasonable judgment, there is credible evidence or reasonable suspicion that a Guest has caused or contributed to damage, loss, or excessive cleaning, the Guest will be held financially accountable. South Forty may, at its discretion, provide supporting documentation or repair estimates to substantiate the charge. The Operator’s determination of responsibility and associated costs will be considered final.
6. Luggage & Personal Effects
a. Allowance:
i. Checked Bag: 1 per guest, maximum sixty-two linear inches (62”) combined (length + width + height) and a maximum weight of twenty kilograms/forty-four pounds (20kg/44 lbs)
ii. Carry-on: 1 small item, maximum forty-five linear inches (45”) combined and maximum of five kilograms/ten pounds (5kg/10lbs)
iii. Overweight, Over-dimension, or Excess luggage items may be accepted by the driver on a case-by-case first come first served basis, and will be subject to a handling fee of fifty Canadian dollars (CAD$50.00) per item.
b. Hazardous or Restricted Items:
i. Flammable, corrosive, any hunting equipment, or illegal items are strictly prohibited. Refer to Transport Canada’s guidelines for restricted materials.
c. Liability
i. South Forty is not liable for loss, theft, or damage to personal items except in cases of gross negligence. Liability for passenger property is limited to five-hundred Canadian dollars (CAD$ 500.00) per guest.
7. Insurance & Compliance
a. All vehicles are insured per Alberta and Canadian commercial standards with five million Canadian dollar (CAD$ 5,000,000.00) liability coverage.
b. Guests are strongly encouraged to carry personal, medical, and travel insurance.
c. Drivers retain full authority, on behalf of South Forty, over routing and safety decisions in accordance with Hours-of-Service regulations (Federal Hours of Service, Cycle 1)
8. Health and Accessibility
a. Guests must be fit to participate in tour activities. Any medical conditions should be disclosed at booking.
b. South Forty will make reasonable efforts to accommodate dietary and mobility requirements but cannot guarantee availability of specific services at all locations.
9. Liability and Waiver
a. Participation is voluntary and at the Guest’s own risk
b. South Forty, its employees, agents, or contractors will not be liable for injury, death, loss, delay, or damage arising from any cause beyond its control
c. Guests agree to indemnify and hold harmless South Forty from claims arising from their own actions or omissions
10. Jurisdiction
a. These Terms and Conditions are governed by the laws of the Province of Alberta and the laws of Canada applicable therein. Any dispute arising under or in connection with this agreement shall be resolved in the Judicial District of Medicine Hat, Province of Alberta, which shall serve as the exclusive venue for any legal proceedings. South Forty Transportation Ltd. is headquartered in the County of Forty Mile (No. 8), Alberta.
11. Acknowledgement
a. This agreement constitutes the entire agreement between the parties and supersedes all prior negotiations or representations.
b. The purchaser acknowledges having read and understood these Terms and Conditions and accepts them on behalf of all guests listed on the booking
12. Signing and Acceptance
a. This agreement may be executed and delivered by electronic signature, scanned copy, or PDF, each of which will be deemed an original and together will constitute one and the same agreement.
b. Acceptance by Payment:
i. Payment in full, in whole or in part, for any Tour constitutes acknowledgment and acceptance of these terms and conditions by the Purchaser on behalf of all Guests listed in the booking, whether or not a separate signature has been provided.
c. Authority
i. By signing or submitting payment, the Purchaser confirms that they have read, understood, and agreed to these terms and conditions and have the authority to bind all Guests included in the booking.
13. Privacy
a. Personal information collected in connection with this booking will be used solely for operational, insurance, and regulatory purposes in accordance with applicable privacy law.
